Q: What do I have to do to claim a mechanic's lien?
A: If you perform work or provide materials utilized in the construction of improvements to real property, you may claim a lien against the property if:
1. You file the lien with the County Clerk and Recorder of the County in which the property is located within four months (not 102 days) after the date of your last substantial work on the property;
2. You give notice of your intent to file a lien at least ten days before you file the lien;
3. The notice of intent is sent by registered or certified mail, return receipt requested to the owner (or reputed owner) and the general contractor;
4. The lien statement must contain a sufficient legal description and/or address to adequately identify the property.
After you've given notice and filed the lien, other deadlines kick in relative to the filing of a lawsuit to foreclose the lien.
