Denver, Colorado Mediation and Arbitration Lawyers

Mediation is a dialogue facilitated by a trained, knowledgeable, skillful and neutral third party designed to help the parties in resolving their legal dispute and in satisfying their needs, interests and goals. It can be court-ordered or voluntary. Mediation can be, and is, used to resolve, among other things, conflicts between family members, business owners, landlords and tenants, neighbors, and employers and employees. Often, those conflicts revolve around personal differences and miscommunications rather than legal issues. The negotiation orientation of mediation makes that process ideal for resolving those and other nonlegal disputes.
Both Jordan Hochstadt and Andy Silverman have successfully mediated a wide variety of matters, including:
- Commercial disputes;
- Homeowners/Homeowners Association disputes;
- Family Law disputes;
- Real Estate disputes, including those between Landlords and Tenants;
- Family Owned Business disputes;
- Professional Liability disputes;
- Estate and Probate disputes; and
- Construction Disputes
Jordan Hochstadt and Andrew Silverman understand that each case is unique and special to the parties. The diversity of subject matter, the spectrum of complexity, and the variety of personalities, all require individualized design considerations. They understand that the mediator's toolbox must be filled with creative styles and approaches to assist parties in building a bridge to the resolution of their conflict. This individualized proactive approach is effective in bringing cases to closure. It fosters early dispute resolution and results in both transactional cost savings and reduction of emotional costs.
The toolbox utilized by Jordan Hochstadt and Andrew Silverman includes co-mediation, staggered starts, pre-mediation caucuses, pre-mediation design, and focused follow-up. Conflict resolution tools are not sufficient without recognizing the emotional factors involved in each case. Messers. Hochstadt and Silverman utilize sensitivity, empathy, respect, honesty, and integrity whether dealing with business partners, family businesses, or professionals. They endeavor to bring creative energy, pragmatism, intellect, instinct, and peacemaking skills to facilitate closure to conflict. They are comfortable taking non-traditional approaches to dispute resolution.

ARBITRATION
Arbitration is a process in which a neutral individual or panel listens to the issues in the dispute and renders a decision regarding liability and damages. Voluntary arbitration allows the parties to select the individual or panel. Generally, the cost or the arbitrator(s) is split equally. Non-binding arbitration allows parties to refuse the decision and move on to the court process. Binding arbitration, which is more common, generally means that neither party can appeal the decision or take it into court.
Jordan Hochstadt, Andrew Silverman, Richard Strauss and George Straw serve as arbitrators for the above-listed subject areas.
MED-ARB
Med-Arb is a full mediation session followed by a full arbitration session if the mediation session is not successful in resolving all of the disputed issues. A mediator is pre-selected by the parties and, generally, a separate arbitrator is either pre-selected by the parties or the parties will wait to select an arbitrator based on the specialization that the arbitrator will need to posses in order to understand and handle the issues being presented to arbitration. As noted above, Jordan Hochstadt, Andrew Silverman, Richard Strauss and George Straw are also available to serve as arbitrators for the above-listed subject areas.
